Contrato de Licencia de Usuario Final

Este Contrato de Licencia de Usuario Final ("Licencia") es un acuerdo entre tú ("usuario") e Irma Erika Yang (persona física con actividad empresarial), México, titular de la aplicación Sánate (la "App"). Al descargar, instalar o usar la App, aceptas esta Licencia.

1. Otorgamiento de licencia

Te otorgamos una licencia personal, limitada, no exclusiva, intransferible y revocable para instalar y usar la App en dispositivos que poseas o controles, únicamente para tu uso personal y no comercial, conforme a esta Licencia y a las reglas de uso de la tienda (Apple App Store o Google Play) desde la que la obtuviste.

2. Restricciones

No podrás: (a) copiar, modificar o crear obras derivadas de la App; (b) realizar ingeniería inversa, descompilar o desensamblar la App, salvo en la medida permitida por la ley; (c) alquilar, prestar, vender, sublicenciar o distribuir la App; (d) eliminar avisos de propiedad; ni (e) usar la App para fines ilícitos o no autorizados.

3. Propiedad

La App se licencia, no se vende. Todos los derechos de propiedad intelectual sobre la App, su código, diseño, marca "SÁNATE" (en trámite ante el IMPI) y contenido pertenecen a Irma Erika Yang. Conservas la propiedad del contenido que tú creas (por ejemplo, tu diario).

4. Contenido y servicios de terceros

La App puede integrar servicios de terceros (proveedores de IA, almacenamiento, correo, pagos). Su uso puede estar sujeto a los términos de dichos terceros. No somos responsables del contenido o las prácticas de terceros.

5. Suscripciones de pago

Las funciones de pago se rigen también por nuestros Términos y Condiciones. Los cobros, renovaciones y reembolsos los gestionan Apple o Google.

6. Naturaleza del servicio

La App ofrece apoyo de bienestar emocional y no sustituye atención médica, psicológica o de emergencia. Consulta el Aviso Médico.

7. Renuncia de garantías

En la medida permitida por la ley, la App se proporciona "tal cual" y "según disponibilidad", sin garantías de ningún tipo, expresas o implícitas, incluidas las de comerciabilidad o idoneidad para un fin particular.

8. Limitación de responsabilidad

En la medida permitida por la ley, no seremos responsables por daños indirectos, incidentales o consecuentes derivados del uso o la imposibilidad de uso de la App.

9. Terminación

Esta Licencia sigue vigente hasta su terminación. Tus derechos terminan automáticamente si incumples cualquier término. Al terminar, debes dejar de usar y eliminar la App.

10. Cumplimiento de exportación

Declaras que no te encuentras en un país sujeto a embargo aplicable ni figuras en listas de partes restringidas, y que no usarás la App para fines prohibidos por la ley.

11. Disposiciones específicas para dispositivos Apple

Si obtuviste la App en el Apple App Store, aplican además los siguientes términos:

Esta Licencia se celebra únicamente entre tú y nosotros, no con Apple. Apple no es responsable de la App ni de su contenido.
La licencia de uso se limita a un uso en dispositivos Apple que poseas o controles, según las Reglas de Uso de los Términos de Servicio de App Store.
Somos los únicos responsables del mantenimiento y soporte de la App; Apple no tiene obligación alguna de proporcionarlos.
Somos responsables de atender cualquier reclamación de garantía aplicable; Apple podrá reembolsar el precio de compra, si aplica.
Somos responsables de atender reclamaciones relacionadas con la App (responsabilidad de producto, incumplimiento legal, protección al consumidor o privacidad).
En caso de reclamación de un tercero por infracción de propiedad intelectual, seremos nosotros, y no Apple, los responsables de su investigación y defensa.
Apple y sus subsidiarias son terceros beneficiarios de esta Licencia y podrán hacerla valer en tu contra.

12. Ley aplicable

Esta Licencia se rige por las leyes de los Estados Unidos Mexicanos, sin perjuicio de los derechos de los consumidores.

End User License Agreement

This End User License Agreement ("License") is an agreement between you ("user") and Irma Erika Yang (sole proprietor), Mexico, owner of the Sánate application (the "App"). By downloading, installing, or using the App, you accept this License.

1. License grant

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, solely for your personal, non-commercial use, subject to this License and the usage rules of the store (Apple App Store or Google Play) from which you obtained it.

2. Restrictions

You may not: (a) copy, modify, or create derivative works of the App; (b) reverse engineer, decompile, or disassemble the App, except to the extent permitted by law; (c) rent, lease, sell, sublicense, or distribute the App; (d) remove proprietary notices; or (e) use the App for unlawful or unauthorized purposes.

3. Ownership

The App is licensed, not sold. All intellectual property rights in the App, its code, design, the "SÁNATE" trademark (pending with Mexico's IMPI), and content belong to Irma Erika Yang. You retain ownership of the content you create (e.g., your journal).

4. Third-party content and services

The App may integrate third-party services (AI providers, storage, email, payments). Their use may be subject to those third parties' terms. We are not responsible for third-party content or practices.

5. Paid subscriptions

Paid features are also governed by our Terms and Conditions. Charges, renewals, and refunds are handled by Apple or Google.

6. Nature of the service

The App provides emotional wellness support and does not replace medical, psychological, or emergency care. See the Medical Disclaimer.

7. Disclaimer of warranties

To the extent permitted by law, the App is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability or fitness for a particular purpose.

8. Limitation of liability

To the extent permitted by law, we will not be liable for indirect, incidental, or consequential damages arising from the use or inability to use the App.

9. Termination

This License remains in effect until terminated. Your rights terminate automatically if you breach any term. Upon termination, you must stop using and delete the App.

10. Export compliance

You represent that you are not located in an embargoed country and are not on any restricted-party list, and that you will not use the App for purposes prohibited by law.

11. Apple device-specific provisions

If you obtained the App from the Apple App Store, the following terms also apply:

This License is between you and us only, not with Apple. Apple is not responsible for the App or its content.
The license is limited to use on Apple-branded devices you own or control, per the App Store Terms of Service Usage Rules.
We are solely responsible for maintenance and support of the App; Apple has no obligation to provide them.
We are responsible for handling any applicable warranty claim; Apple may refund the purchase price, if applicable.
We are responsible for addressing claims relating to the App (product liability, legal compliance, consumer protection, or privacy).
In the event of a third-party intellectual property infringement claim, we, not Apple, are responsible for its investigation and defense.
Apple and its subsidiaries are third-party beneficiaries of this License and may enforce it against you.

12. Governing law

This License is governed by the laws of the United Mexican States, without prejudice to consumer rights.

3. 所有权

本应用为许可使用，并非出售。本应用及其代码、设计、"SÁNATE" 商标（正在墨西哥 IMPI 申请中）和内容的所有知识产权均归 Irma Erika Yang 所有。您保留对自己创建内容（如您的日记）的所有权。

4. 第三方内容与服务

本应用可能集成第三方服务（AI 服务商、存储、邮件、支付）。其使用可能受该等第三方条款约束。我们对第三方内容或做法不承担责任。

5. 付费订阅

付费功能同时受我们的使用条款约束。收费、续订和退款由 Apple 或 Google 处理。

6. 服务性质

本应用提供情绪健康支持，不能替代医疗、心理或急救服务。请参阅医疗声明。

7. 免责声明

在法律允许的范围内，本应用按"现状"和"可用状态"提供，不作任何明示或默示的保证，包括适销性或特定用途适用性。

8. 责任限制

在法律允许的范围内，对于因使用或无法使用本应用而产生的间接、附带或后果性损害，我们概不负责。

9. 终止

本许可在终止前持续有效。若您违反任何条款，您的权利将自动终止。终止后，您须停止使用并删除本应用。

10. 出口合规

您声明您不位于受适用禁运的国家，也不在任何受限方名单中，且不会将本应用用于法律禁止的目的。

11. Apple 设备专项条款

若您从 Apple App Store 获取本应用，则以下条款同样适用：

本许可仅在您与我们之间订立，与 Apple 无关。Apple 对本应用及其内容不承担责任。
许可仅限在您拥有或控制的 Apple 品牌设备上使用，须遵守 App Store 服务条款的使用规则。
本应用的维护和支持由我们独自负责；Apple 没有任何提供义务。
我们负责处理任何适用的保证索赔；如适用，Apple 可退还购买价款。
我们负责处理与本应用相关的索赔（产品责任、违法、消费者保护或隐私）。
如发生第三方知识产权侵权索赔，由我们而非 Apple 负责其调查和抗辩。
Apple 及其子公司是本许可的第三方受益人，有权对您强制执行本许可。

12. 适用法律

本许可受墨西哥合众国法律管辖，且不影响消费者权利。

我們授予您一項個人、有限、非專屬、不可轉讓且可撤銷的授權，允許您在自己擁有或控制的裝置上安裝和使用本應用程式，僅供個人非商業用途，並須遵守本合約以及您取得本應用程式之商店（Apple App Store 或 Google Play）的使用規則。

本應用程式可能整合第三方服務（AI 服務提供者、儲存、郵件、支付）。其使用可能受該等第三方條款約束。我們對第三方內容或做法不承擔責任。

5. 付費訂閱

付費功能同時受我們的使用條款約束。收費、續訂和退款由 Apple 或 Google 處理。

6. 服務性質

11. Apple 裝置專項條款

授權僅限在您擁有或控制的 Apple 品牌裝置上使用，須遵守 App Store 服務條款的使用規則。
